Kepala Seksi Penerangan Hukum Kejati Bali Putu Agus Eka Sabana Putra di Denpasar, Bali, Selasa mengatakan penangguhan penahanan tersangka Haryo Seto karena adanya jaminan institusional dari Direktorat Jenderal Imigrasi dan Kepala Kantor Imigrasi Khusus Kelas I TPI Ngurah Rai bahwa tersangka dijamin tak akan melarikan diri selama proses penanganan kasus tersebut.
Hal itu penting mengingat alasan penahanan terhadap tersangka sebagaimana Pasal 21 ayat (1) KUHAP yakni kekhawatiran bahwa tersangka atau terdakwa akan melarikan diri, merusak atau menghilangkan barang bukti dan atau mengulangi tindak pidana.
“Mempertimbangkan adanya jaminan institusional tersebut bahwa tersangka HS tidak akan melarikan diri, menghilangkan barang bukti dan mengulangi tindak pidana sebagaimana permohonan penangguhan, terhitung Senin tanggal 27 November 2023 penyidik menangguhkan penahanan terhadap diri tersangka HS,” kata Eka Sabana.
Menurut Eka, penyidik telah mempertimbangkan dengan seksama surat permohonan penangguhan
penahanan yang ditandatangani oleh Dirjen Imigrasi tertanggal 21 November 2023 dan surat Kepala Kantor Imigrasi Khusus Kelas I TPI Ngurah Rai yang diajukan dengan alasan untuk kepentingan pemeriksaan internal dan evaluasi.
Namun demikian, tindakan penangguhan terhadap tersangka HS tidak menghentikan proses penyidikan dalam perkara pungutan liar layanan jalur cepat (fast track) imigrasi.
“Penyidik telah memeriksa sejumlah saksi dan mengumpulkan berbagai barang bukti serta diharapkan dalam waktu dekat terdapat perkembangan baru yang bisa kami sampaikan kepada publik,” katanya.
Selama dibebaskan dari tahanan, tersangka HS diwajibkan melaporkan diri kepada penyidik Kejaksaan Tinggi Bali setiap Senin dan Jumat serta kewajiban lain yang ditentukan oleh penyidik.
Kejaksaan Tinggi Bali mengapresiasi komitmen jajaran kantor imigrasi Khusus Kelas I TPI Ngurah Rai untuk melakukan
perbaikan sistem dan tata kelola pelayanan keimigrasian untuk mencegah terulangnya kembali penyimpangan serupa di masa mendatang.
Sebelumnya, Kepala Kantor Imigrasi Ngurah Rai Putu Suhendra meminta penangguhan penahanan terhadap tersangka HS dengan alasan melakukan pemeriksaan internal dan evaluasi.
Permohonan penangguhan penahanan itu diajukan pada Rabu (22/11).
Menurut keterangan Suhendra, Haryo Seto telah dinonaktifkan dari jabatannya sebagai Kepala Seksi Pemeriksaan I Kantor Imigrasi Kelas I Khusus TPI Ngurah Rai.
