Kejati Jambi Siapkan Berkas Dakwaan Perkara Korupsi Di PT Pelindo II

Wto Sport – Kejaksaan tinggi (Kejati) Jambi sedang meneliti dan menyiapkan berkas dakwaan untuknperkara tiga terdakwa tindak pidana korupsi pada PT Pelindo Regional II Jambi yang telah merugikan negara senilai Rp3,9 miliar pada proyek upgrade Stasiun Pandu Teluk Majelis Pelabuhan Jambi (Pelindo) Tahun Anggaran 2019-2021.

Kepala seksi penerangan dan hukum (Kasi Penkum) Kejati Jambi Lexy Fatharany di Jambi, Rabu, mengatakan saat ini tim jaksa sedang meneliti dan sekaligus mempersiapkan berkas dakwaan untuk para tersangka korupsi PT Pelindo Jambi yakni atas nama Andrianto Rahmadah(PJ DJM operasi dan teknik cabang Pelabuhan Jambi), Chepy Rymeta Atmaja (mantan GM Pelindo cabang Jambi) dan Sanda Trisharjanto(GM Cabang Pelabuhan Jambi).

Selanjutnya, Kejaksaan Tinggi Jambi juga sudah menerima hasil perhitungan kerugian negara dari BPKP senilai Rp3,92 miliar, sedangkan untuk dua tersangka yang lainnya atas nama Ibrahim(Direktur 4 Cipta Konsultan) dan MT Yombi Laras Sandi (Direktur Utama Waybekhak Perkasa, yang berkas perkaranya di Kejari Tanjabtim.

“Dalam kasus ini ada lima orang tersangka dimana tiga tersangka dilimpahkan penyidik Polda Jambi, dimana tiga tersangka ditangani atau dilimpahkan ke Kejati Jambi sedangkan dua tersangka lainnya ditangani Kejari Tanjabtim,” kata Lexy.

Sebelumnya, Tim Subdit III Tipikor Ditreskrimsus Polda Jambi telah menetapkan lima orang tersangka dugaan korupsi pekerjaan upgrade Stasiun Pandu Teluk Majelis Pelabuhan Jambi (Pelindo) Tahun Anggaran 2019-2021.

Kelima tersangka yang ditetapkan oleh tim penyidik yaitu ST (GM PT Pelindo II Cabang Pelabuhan Jambi 2019-2021), CRA (GM PT Pelindo II Cabang Pelabuhan Jambi 2021-2023), AR (Deputi GM Operasi dan Teknik Pelindo II Cabang Pelabuhan Jambi 2020-2023), YL (Dirut PT Way Berhak Perkasa) dan MIH (Konsultan Pengawas).

Ditemukan kerugian negara sebesar Rp3,9 miliar dan penyidik dalam proses penyelidikan telah berhasil melakukan proses penyitaan sebagai bentuk pemulihan kerugian keuangan negara berupa uang tunai sebesar Rp3,4 miliar.

Kasus ini bermula pada tahun 2018 ketika PT Pelindo II menganggarkan anggaran investasi multiyears untuk membangun stasiun pandu tersebut. Pada 3 Desember 2019 sampai dengan 31 Januari 2020 dilakukan proses tender.

Dalam proses tender itu ditetapkan PT. Way Berhak Perkasa sebagai pemenang, lalu pada 21 Februari 2020 dilakukan penandatanganan kontrak antara saudara ST selaku GM Pelindo Jambi dengan saudara YL selaku Dirut PT. Way Berhak Perkasa dengan nilai kontrak sebesar Rp12 miliar dengan masa pelaksanaan selama 240 kalender.

Pada 11 Agustus 2020, saudara YL selaku kontraktor mengalihkan semua pekerjaan fisik kepada pihak lain. Pada 11 Juni 2021 dilakukan pemutusan kontrak oleh PT Pelindo II (Persero) cabang pelabuhan Jambi dengan progres fisik sebesar 91,946 persen dan Pelindo II melakukan pembayaran kepada pemenang tender sebesar Rp10 miliar.

Setelah dilakukan proses penyelidikan bersama oleh Subdit Tipidkor Polda Jambi bersama unit Tipidkor Polres Tanjung Jabung Timur, ditemukan beberapa perbuatan melawan hukum.

Perbuatan melawan hukum itu seperti proses tender yang sudah diatur, laporan progres pekerjaan yang direkayasa, proses adendum pekerjaan yang tidak sesuai ketentuan, mengalihkan semua pekerjaan ke kontraktor lain dan perbuatan melawan hukum lainnya.

Atas perbuatannya tersebut lima orang tersangka terancam pasal 2 ayat 1 dan pasal 3 Jo pasal 55 ayat 1 ke-1 KUHPidana dengan ancaman pidana penjara paling singkat empat tahun dan paling lama 20 tahun dengan denda paling sedikit Rp200 juta dan paling banyak Rp1 miliar.
