“Jadi sebenarnya dalam RUU kali ini tidak hanya mengurusi urusan sanksi tapi juga mengamankan soal topik transaksi digital. Sesuai dengan UU ini yang namanya UU Informasi dan Transaksi Elektronik,” kata Meutya di Gedung Nusantara II DPR RI, Jakarta Pusat, Rabu.
Selain menyesuaikan muatan dengan nama dari regulasi terkait, alasan topik Transaksi Elektronik ini juga untuk menanggapi semakin banyaknya kasus terkait dengan penipuan yang terjadi di ruang siber.
Di 2020 saja, Kepolisian Republik Indonesia mencatat ada sebanyak 7.047 kasus penipuan digital yang dilaporkan, sebagian besar di antaranya terjadi melalui media sosial dengan modus yang sangat beragam.
Selain media sosial, selama 2021, Yayasan Lembaga Konsumen Indonesia (YLKI) juga mencatat ada 535 kasus yang diadukan konsumen, dengan rincian 22,4 persen aduan berasal dari konsumen pinjaman online (pinjol), terutama terkait cara penagihan dan keberadaan pinjol ilegal. Selanjutnya, 16,6 persen aduan berasal dari konsumen belanja online. Data itu meningkat 33 persen dari total aduan tahun sebelumnya yaitu 2020.
Dalam penelitian bertajuk “Penipuan Digital di Indonesia: Modus, Medium, dan Rekomendasi” yang dirilis di 2022 juga mengungkap bahwa kerugian uang menjadi kerugian terbesar dari korban penipuan elektronik dengan persentase 15,2 persen dari 1700 responden yang mengikuti penelitian tersebut.
Berkaca dari banyaknya kasus tersebut maka dari itu topik transaksi elektronik semakin diperkuat dalam naskah RUU perubahan kedua UU ITE yang dalam waktu dekat akan dibahas pada pembicaraan tingkat dua di Rapat Paripurna DPR RI.
“Banyak kasus bahwa UU ITE ini justru bukan digunakan untuk menindak penipuan elektronik padahal terkait. Dengan masukan lewat RDPU (Rapat Dengar Pendapat Umum) yang kami lakukan, kami ingin menyempurnakan ekosistem digital khususnya untuk transaksi elektronik itu diperbaiki,” ujar Meutya.
